I'd think that a SWPA theatre might raise quite a few eyebrows and a few "WTF, after all the troubles with NG aircraft!?!?!?" too. But having a go at Hawaii and Papua New Guinea with the new engine might be tempting. Who knows they've contacted NG in advance now and reached an agreement, or now know to circumvent the legal issues.

When the original IL-2 series was doing the Pacific Campaign they ran into difficulties when some aircraft manufactures or the people who owned the rights to those aircraft wanted royalties for the use of their aircraft in the sim. Ubisoft balked and these aircraft were dropped from the sim.

Hopefully this will be settled before the new series develops the Pacific campaign. Although Oleg said those people should be paying him for advertising their product.
