Default Malicious intent: it's not present.

I will state this shortly and simply.

Foo'bar was banned for apparent 'malicious intent' and when it was clear this wasn't present the reason given was that he caused damage to user's systems.

So damage was done (apparently).

We have moderators who use ignore lists, and thus don't moderate efficiently or effectively, and clearly lack the unbiased, separate nature a moderator is required to have.

Hence damage is done, and will continue to be done.

I struggle to see the difference, especially when one is clearly intentional.

Please not as well: there is no suggestion here that the moderators are inefficient (so no grounds to get me into trouble) but rather my realistic perception that such a lack of objectiveness and fairness will always reap poor results.
