Nope sorry mate its not the patch, its just your connection. The patch will happen (if ever) when you first launch the game. It will disconnect you from xbox live.
If your still having trouble mate then just reset your router etc, give it 30 seconds then turn it on again
Just dont be getting your hopes up for a patch lol
